Terms of Use

Article 1 (Purpose)

These Terms of Use govern the use of services (hereinafter “Services”) provided through the application (“GO!GO! Rental Car & Activity Platform”) operated by Smartbox Co., Ltd. (hereinafter “Company”).

Article 2 (Definitions)

1. “Company” refers to Smartbox Co., Ltd., which provides the Services.
2. “User” refers to any person who agrees to these Terms and uses the Services.
3. “Reservation Holder” refers to an individual who has provided personal information to the Company and made a reservation.
4. “Guide” refers to an individual who provides guide services to travelers at the travel destination.
5. “Affiliated Store” refers to a business that provides travel products to travelers through the Company.

Article 3 (Amendment of Terms)

1. The Company shall post these Terms, along with its company name, representative name, business address, phone number, email address, business registration number, and privacy officer information on the initial page of its website.
2. The Company may amend these Terms within the scope permitted by applicable laws, including the Act on Consumer Protection in Electronic Commerce.
3. When amending these Terms, the Company shall announce the effective date, content, and reason at least 7 days prior to the effective date. For changes unfavorable to users, at least 30 days prior notice shall be given.

Article 4 (Service Provision and Changes)

1. The Company shall perform the following tasks: (1) Providing information and booking for services directly sold by the Company; (2) Mediating service contracts, including travel agreements with affiliated stores; (3) Other tasks designated by the Company.
2. The Company provides only a platform to facilitate transactions between affiliated stores and users and is not responsible for completed transactions.
3. If the Company changes the content of services under contract, it will promptly notify users.

Article 5 (Suspension of Services)

The Company may temporarily suspend Services in cases of maintenance, equipment failure, network interruption, national emergencies, natural disasters, or other unavoidable circumstances.

Article 6 (Management of Posts)

The Company may remove or reject posts that defame others, violate public order, promote illegal activities, infringe on intellectual property rights, or otherwise violate applicable laws.

Article 10 (Information Provision and Advertising)

The Company may provide users with necessary information via email or SMS. The Company is not liable for any damages arising from users’ participation in third-party promotions accessed through the Services.

Article 11 (Payment Methods)

Payments for Services may be made by: (1) Bank transfer; (2) Credit card; (3) Other methods designated by the Company.

Article 12 (Liability and Disclaimer)

1. The Company’s liability for damages caused by its intentional acts or gross negligence shall be limited to the amount paid by the user.
2. Users who violate these Terms shall compensate the Company for all resulting damages.
3. The Company is exempt from liability in cases of natural disasters, telecommunications service interruptions, equipment maintenance, user negligence, or services provided free of charge.

Article 12 (Cancellations and Refunds)

If a reserved service becomes unavailable, the Company shall promptly notify the user and process a refund within 7 business days of receiving payment.

Article 14 (Privacy Policy)

Matters relating to the protection of personal information are governed by the Company’s separately published Privacy Policy.

Article 15 (Company Obligations)

The Company shall not engage in acts prohibited by law or public order, and shall make its best efforts to provide continuous and stable Services, including maintaining security systems to protect users’ personal information.

Article 16 (User Obligations)

Users must not: (1) Register false information; (2) Steal others’ information; (3) Modify information posted by the Company; (4) Infringe on intellectual property rights; (5) Engage in defamation or interference with business; (6) Post obscene or violent content; (7) Directly transact with guides or affiliated stores without the Company’s mediation.

Article 17 (Copyright)

1. Copyright and other intellectual property rights for content created by the Company belong to the Company.
2. Users may not copy, transmit, publish, or use for commercial purposes any information owned by the Company without prior consent.

Article 19 (Dispute Resolution)

The Company shall operate a dispute resolution mechanism in accordance with applicable laws and internal policies to address legitimate complaints from users.

Article 20 (Jurisdiction and Governing Law)

1. Disputes between the Company and users shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company’s principal place of business.
2. Japanese law shall apply to disputes between the Company and users.

Supplementary Provisions

These Terms shall take effect from August 1, 2017.
